FEES AND SERVICES When you list an item or use a service that has a fee you have an opportunity to review and accept the fees that you will be charged based on our Fees schedule, which we may change from time to time. You are responsible for paying all fees and applicable taxes associated with our sites and services in a timely manner with a valid payment method. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms. When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, trademark, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future. We are not involved in the actual transaction between buyers and sellers. You agree that any claim or dispute you may have against gizmoplans.com must be resolved by a court located in Duluth, St. Louis County, Duluth, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within St. Louis County, Duluth, for the purpose of litigating all such claims or disputes. ARBITRATION Any disputes between the buyer or the other designer and gizmoplans.com or gizmoplans’ agents, officers and employees will be resolved by arbitration pursuant to the original arbitration rules existing at that time for the Minnesota Arbitration Association. Any arbitration will be subject to the laws of the state of Minnesota. Any arbitration should be held in Duluth, St. Louis County, Minnesota. MODIFICATION & SALE OF PLANS The plan is protected by the trademark and copyright of gizmoplans.com or other designer. The plan may be protected by one or more patents. Buyer and all other persons and entities are prohibited from selling an original or a modified version of the plan without consent of gizmoplans.com, if gizmoplans.com is the designer, or the consent of other designer, if other designer has designed the plans. PLANS OF THE OTHER DESIGNERS: Gizmoplans and its offers and agents are not responsible in any way for the design, instructions, warranties, merchantability, suitability for particular use, liability and tort, contract or otherwise for these plans which are designed and which are owned by persons or entities other than gizmoplans. com. Gizmoplans.com makes no representations or warranties and has no responsibility regarding any claims of infringement, patent, trademark or copyright by these plans which were designed and are owned by entities other than gizmoplans.com. Gizmoplan’s only responsibility to the buyer is to make the plans available to download to the buyer upon payment by buyer. Plans which are available for download on the pages have plans which are not designed or owned by gizmoplans.com. Contact information for other designers is provided with other designer’s plans or other materials. Buyer should refer to the plans and these other materials for contact information for the other designer. GOVERNING LAW This agreement and all transactions between gizmoplans.com, the buyer and any other designer shall be governed by the laws of the state of Minnesota. The buyer consents to the jurisdiction of the State of Minnesota, the Courts of the state of Minnesota, and the arbitration in the state of Minnesota. SALE ONLY TO THE ORIGINAL PURCHASER The sale of this plan is made only to the original purchaser. The original purchaser is prohibited from selling, transferring, assigning, gifting, or otherwise letting other persons or entities have possession or use of the plans in any form, whether electronic form, paper form, photographic form, or other form. Any and all obligations of gizmoplans.com and other designer are only to the original buyer and not to any other person or entity. The plan is not for the benefit of any third party, and no third party has any rights against gizmoplans.com or other designer.
